Adoption of Draft Law on Planning and Construction would have immense effects on Montenegrin society and cancellation of construction permits would nullify control over construction, were the conclusions of extended session of MEF Board for Construction that was held today.
Participants highlighted that the draft law violated the legislative procedure in a way that the subject in question had not gone through public consultations since the newly proposed solution almost completely differs from the draft of the same law that went through public consultation process in 2015.
According to participants, the suggested law on planning and construction means “a complete crash of architects’ profession” whereby it totally abolishes planning, licences and rights of a certain number of business entities.
“According to Chamber of Engineers’ registry, there are around 175 business entities licenced for planning and around 350 natural persons that own the licence for planning in Montenegro. It means that all these people will lose their jobs if this law passes”, said one of the Board members, further explaining that the complete planning documents, their development, implementation and control were to be moved to the Ministry which, according to him, means total centralisation of planning.
The situation calls for urgent session of the Social Council so that the Draft Law as such does not go into the Parliament procedure, participants agreed.
Adoption of the Law with proposed solutions could cause numerous problems that, inter alia, will manifest in shut down of small and medium-sized companies, since it is directed against a great number of companies dealing with planning and construction and, what is even worse – a great number of engineers that have done those jobs so far.
